Probate in New Mexico

According to Bernalillo County Probate Court, "Probate is the court process to obtain the legal authority to act on behalf of the estate of a person who has died (decedent)."

Process:

Probate must be filed within three years following the decedent's death.
Probate in New Mexico does NOT require a lawyer.
Submit death certificate, application, and order.
Court reviews case and puts it on the docket.
Estate is distributed to the decedent's will or through NM laws of interstate succession.
